Welcome to the website for the Tour Guides Association of Greater New Orleans, Inc. ("TGAGNO," “TGAGNOI”, "we," "us," or "our"). These Terms and Conditions govern your use of our website located at tourguidesnola.org and all associated services, content, and functionality (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to all of these terms, do not use this Site.

1. Acceptance of Terms

By accessing or using this Site, you confirm that you are of legal age and have the capacity to enter into this agreement. If you are using the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms and Conditions.

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. We will indicate the date of the last revision at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. It is your responsibility to review these terms periodically for changes.

3. Website Purpose and Limitations

The Site serves as a resource for information about TGAGNO, its members, events, and the Greater New Orleans tourism industry. It is provided for informational and educational purposes only.

No Endorsement: TGAGNO does not endorse or guarantee the services of any individual member or tour operator listed on the Site. Any information on this Site about specific guides or companies is for informational purposes only and does not constitute a recommendation.
No Liability for Third-Party Content: We are not responsible for the accuracy, completeness, or reliability of any information provided by third parties, including member profiles, linked websites, or user-generated content.
Disclaimer of Warranties: The Site and its content are provided "as is" and "as available," without any warranties of any kind, either express or implied.

4. Intellectual Property

The content, names, graphics, and other materials on this Site are the property of TGAGNO or its affiliates.

The TGAGNO name, logo, and related marks are property of TGAGNO. You may not use these marks without our express written permission.

5. User Conduct and Prohibited Activities

Additional prohibited activities include, but are not limited to:

A. Illegal and harmful activities

Defamation and harassment: Engaging in abusive, threatening, defamatory, or harassing behavior toward any individual, group, or organization, including TGAGNO, its members, or other users.

Security breaches: Attempting to circumvent or interfere with the website's security features, including probing, scanning, or testing its vulnerability.

B. Intellectual property infringement

D. Member-specific prohibitions

Account abuse: For members with login credentials, the sharing of members-only content and password access with anyone outside of TGAGNO is strictly prohibited.
Misleading profiles: Posting false, inaccurate, or deceptive information in your member profile, especially concerning your qualifications or services.
Non-payment of dues: Continued access to member-only content is contingent on the timely payment of membership dues.

E. Penalties for violation of TGAGNO website terms

Violation of TGAGNOI website terms can result in several consequences including, but not limited to:

Termination or suspension of a user’s access to member-only content
Termination or suspension of a user’s access to the entire site
Deletion of a member’s personal profile data
Legal action if a user’s violation causes damage to TGAGNO, its members, or a third party.
Notification to authorities if a user’s activity is criminal (such as posting illegal content, harassment, or committing fraud).
Loss of membership benefits
Revocation of membership

6. Membership-Related Content

For members who have access to member-only sections of the Site, additional rules apply:

Account Information: You are responsible for maintaining the confidentiality of your account information and password for all activities that occur under your account. Access and/or sharing of member-only content and access and/or sharing of TGAGNO site passwords to anyone outside of TGAGNO is strictly prohibited.
Member-Generated Content: If you post or upload content to the Site, you grant TGAGNO a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the Site and TGAGNO's mission.
Membership Dues: Your access to member-only content is contingent upon your timely payment of membership dues, as outlined in your separate membership agreement.

7. Third-Party Links

The Site may contain links to third-party websites for your convenience. TGAGNO has no control over, and assumes no responsibility for, the content or privacy practices of these sites. The inclusion of a link does not imply endorsement by TGAGNO.

8. Limitation of Liability

In no event shall TGAGNO, its directors, employees, or agents be liable for any damages (including, without limitation, direct, indirect, incidental, punitive, or consequential damages) arising out of or in connection with your use of the Site or the inability to use the Site, even if TGAGNO has been advised of the possibility of such damages.
